1. Acceptance of Terms
By accessing or using the bookea.dj platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who wish to access or use the Service.
2. Description of Service
bookea.dj provides a web-based platform that allows electronic music DJs and agencies to create professional profiles, manage booking inquiries, and showcase their work. The Service includes profile pages, mix hosting, booking management tools, analytics, and AI-powered features. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3. User Accounts
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. User Content
Our Service allows you to upload, submit, store, send, or receive content including text, images, audio files, and other materials ("User Content"). You retain ownership of any intellectual property rights that you hold in that User Content. By uploading content to bookea.dj, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and providing the Service.
5. Acceptable Use
You agree not to use the Service to: (a) upload content that you do not have the right to share; (b) infringe upon the intellectual property rights of others; (c) upload malicious software or harmful code; (d) harass, abuse, or harm other users; (e) impersonate any person or entity; (f) engage in any activity that interferes with or disrupts the Service; (g) scrape, mine, or collect data from the Service without permission; or (h) violate any applicable law or regulation.
6. Subscriptions and Payments
Some features of the Service require a paid subscription. By purchasing a subscription, you agree to pay the applicable fees as described on our Pricing page. Subscriptions are billed on a recurring basis (monthly or annually) until cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis and are not guaranteed.
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of bookea.dj and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of bookea.dj.
8. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Your profile data will be retained for 90 days following termination, after which it may be permanently deleted.
9. Limitation of Liability
In no event shall bookea.dj, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the European Union and applicable local jurisdictions, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the relevant jurisdiction.
